Welcome to Eatsily. These Terms of Use apply when you access or use the Eatsily website, digital menu experiences, demonstrations and related services.
By using Eatsily, you agree to these Terms. If you do not agree with these Terms, you should not use the service.
1. About Eatsily
Eatsily provides a digital layer for hospitality menus designed to help customers explore and understand menu options.
Depending on the venue and available information, Eatsily may display menu items, prices, ingredients, dietary information, nutritional information and other menu-related content. Eatsily may also provide features that help users search, filter or discover menu options based on their preferences.
Eatsily does not prepare, sell or serve food and is not the venue from which food is purchased.
2. Nutritional information
Nutritional information displayed through Eatsily, including calories, protein, carbohydrates, fats and other nutritional values, is provided to help users better understand menu options.
Depending on the venue and stage of the Eatsily experience, nutritional information may be calculated using ingredient and recipe information, supplied by a venue, derived from available food information or estimated for demonstration purposes.
Actual nutritional values may vary due to factors including ingredient brands, portion sizes, preparation methods, recipe changes, substitutions and differences in the food ultimately prepared and served.
Where information is estimated or provided for demonstration purposes, Eatsily may identify this within the relevant experience.
3. Allergies, intolerances and dietary requirements
Eatsily should not be used as the sole source for determining whether a menu item is safe for a food allergy, intolerance or other medical dietary requirement.
Ingredients, preparation methods and potential cross-contact can vary within hospitality environments.
If you have an allergy, intolerance, coeliac disease or another dietary requirement where consuming a particular ingredient could affect your health, you should speak directly with the venue before ordering or consuming food.
Dietary labels and menu information displayed through Eatsily do not constitute a guarantee that a dish is free from a particular ingredient or allergen.
4. Not medical or dietary advice
Information provided through Eatsily is for general informational purposes and is not medical, nutritional or dietary advice.
Eatsily does not replace advice from a doctor, dietitian or other appropriately qualified healthcare professional.
Features that allow users to search for menu items using preferences such as calorie ranges, protein content or dietary characteristics are intended to assist with menu discovery and should not be treated as personalised health advice.
5. Ask Eatsily and menu discovery
Eatsily may provide search, recommendation or menu discovery features, including Ask Eatsily.
Results are generated using the menu information available to Eatsily at the time. Results may not identify every suitable menu item and may occasionally contain incomplete or inaccurate information.
Users should review the relevant menu information and, where necessary, confirm important information directly with the venue before ordering.
6. Venue information
Eatsily may display information relating to participating or prospective venues, including menu items, descriptions, prices, ingredients, images and other venue information.
Hospitality menus change frequently. Venues may change prices, recipes, ingredients, portion sizes, availability or other information without notice.
While Eatsily aims to keep information useful and accurate, Eatsily cannot guarantee that all venue information displayed through the service will always be complete, current or error-free.
7. Demonstration experiences
Eatsily may create demonstration experiences to show venues how the Eatsily service could work with their menu.
Demonstration experiences may use publicly available menu information and may contain illustrative or estimated information, including estimated nutritional values.
Unless expressly stated otherwise, a demonstration should not be interpreted as confirmation that the venue has partnered with, endorsed or adopted Eatsily.
8. Intellectual property
The Eatsily name, branding, software, interface, design, functionality and original content are owned by or licensed to Eatsily and are protected by applicable intellectual property laws.
You may use Eatsily for its intended personal or business-facing purpose, but you must not copy, reproduce, modify, distribute, commercially exploit or create derivative products from Eatsily's proprietary technology, branding or content without permission.
Venue names, logos, menu information and other third-party materials remain the property of their respective owners where applicable.
9. Acceptable use
You must not misuse Eatsily or attempt to interfere with its normal operation.
This includes attempting to gain unauthorised access to the service or its systems, introducing malicious software, using the service for unlawful or fraudulent purposes, impersonating another person or organisation, or using automated methods to excessively scrape, copy or extract Eatsily content or data.
10. Third-party venues and services
Eatsily provides technology and information that can assist customers in navigating hospitality menus.
The venue remains responsible for the preparation, handling, availability, pricing and sale of its food and beverages and for information or services provided directly by the venue.
Eatsily may also contain links to third-party websites or services. Eatsily is not responsible for the content, availability or practices of third-party services.
11. Service availability and changes
Eatsily is continually developing and may add, remove, update or modify features from time to time.
We aim to provide a reliable service but do not guarantee that Eatsily will always be available without interruption, delay or technical error.
12. Liability and consumer rights
To the extent permitted by law, Eatsily is not responsible for loss or damage arising from reliance on information that is inaccurate, incomplete or no longer current where reasonable steps have been taken to provide the service appropriately.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under applicable law, including rights that may apply under Australian consumer law.
13. Changes to these Terms
Eatsily may update these Terms as the service develops or where operational, legal or technological changes require it.
The latest version will be published on this page together with the date it was last updated.
